The Planning and Zoning Commission (P&Z) of the City of Titusville, Florida met in regular session in City Hall Council Chamber located at 555 South Washington Avenue on Wednesday July 19, 2023 at 6:00 p.m.

Chairman Richardson called the meeting to order at 6:00 p.m. Present were Vice Chairman Aton, Member Perez, Member Garrod, Member Moscoso, Alternate Member Childs, and School Board Member Gilbert. Secretary Grant, Member Fayson, and Alternate Member Rogers were absent. Also in attendance were Principle Planner Eddy Galindo, Senior Planner Christie Anderson, Assistant City Attorney Chelsea Farrell and Recording Secretary Laurie Dargie.

Assistant City Attorney Farrell swore in Megan Moscoso as the newest member of the Planning and Zoning Commission.

Member Perez made a motion to approve the minutes from the June 21, 2023 meeting.  Vice Chairman Aton seconded. There was a unanimous voice vote.

Quasi-Judicial Confirmation Procedures

Chairman Richardson asked if the Commission would consider moving to new business items before discussion old business. The Commission members agreed to move to new business first.

 

Member Garrod made a motion to move old business to the end of the meeting agenda. Member Perez seconded. There was a unanimous voice vote in favor.

New Business

 

Chairman Richardson read from an email from Patricia Matthews that requested that Laura Ward be granted permission to speak on her behalf relating to the Small Scale Amendment SSA#6-2023.

Ms. Anderson gave an overview of this item.

 

Yair Knafo, applicant, came to speak in favor of this item.

 

Dan Holland of Titusville came to speak against this item.

 

Leslie Roberts of Titusville came to speak against this item.

 

Quitman Swails of Titusville came to speak against this item.

 

Toni Shifalo of Titusville came to speak against this item.

 

Colleen Grady of Titusville came to speak against this item.

Laura Ward of Titusville came to speak on behalf of Patricia Matthews of Titusville against this item. Ms. Ward provided a handout to the Planning and Zoning Commission members.

 

Member Garrod made a motion to extend Ms. Ward’s speaking time by two (2) minutes. Member Perez seconded. There was a unanimous voice vote.

 

Stan Johnston of Titusville came to speak neither for nor against this item.

 

Yair Knafo gave a brief rebuttal. 

 

Discussion took place amongst the Planning and Zoning Commission members.

Member Garrod made a motion recommending denial of the request based on that it is not consistent with the Future Land Use policy 1.14.4 and policy 1.14.6.  Member Perez seconded.

Old Business

 

Accessory Dwelling Units

Mr. Galindo gave an overview of this item.

 

Assistant City Attorney Farrell provided additional information regarding Senate Bill 250 and advised against adding any restrictive changes to the city’s code due to this Senate Bill.

 

The Planning and Zoning Commission had discussion.

Mr. Galindo explained that he provided Section 28-351 in tonight’s agenda packet with staff comments relating to past discussions in order to help the Commission review what they have discussed and to give direction to staff as to how they would like to proceed with their changes and or recommendations to City Council.

Member Perez made a motion recommending the following change in Section 28-351, (c) (1) (e) to change the twenty-five (25) percent of the entire floor area of the primary dwelling to thirty-five (35) percent of the entire floor area of the primary dwelling. Member Garrod seconded.

Member Childs made a motion recommending the following addition in Section 28-351, (c) (1), and adding the addition of (i) If an accessory dwelling unit exceeds 20% of the entire floor area of the primary dwelling (exclusive of porches or basements) then it shall be compatible in architectural style, color, and exterior facing material to the primary dwelling. Vice Chairman Aton seconded.

Building Height

Member Garrod made comments relating to building height and provided handouts.

 

Discussion took place amongst the Planning and Zoning Commission members and staff.

Member Garrod said in summary that he would like to get clarification on the definition by which building height is determined.

 

Chairman Richardson encouraged Member Garrod to meet with staff and provide and explain the handouts as he did at tonight’s meeting. The building height discussion can be brought back up to the Planning and Zoning Commission in the future.

Petitions & Request

 

Stan Johnston of Titusville came to speak about his professional career and to convey that he is displeased with the city staff. 

 

Toni Shifalo of Titusville came to speak about the future growth of  Titusville and the need for affordable housing.

 

Yair Knafo came to speak about the property at 1625 Tropic Street. Mr. Galindo advised Mr. Knafo to contact him to discuss his property.

Reports

 

Assistant City Attorney Farrell said that the legal department will be reviewing Senate Bill 250 and will be bringing additional information about the Bill to the Commission in the future.

 

Member Garrod said 1,000 Friends of Florida organization provides a webinar summary of recent changes and he would provide staff with a link with information from the conference so that it can be forwarded to the Planning and Zoning Commission members.
