The Planning and Zoning Commission (P&Z) of the City of Titusville, Florida met in regular session in City Hall Council Chamber located at 555 South Washington Avenue on Wednesday May 17, 2023 at 6:00 p.m.

Chairman Richardson called the meeting to order at 6:00 p.m. Present were Vice Chairman Aton, Secretary Grant, Member Perez, Member Garrod, Member Fayson. Alternate Member Childs, Alternate Member Rogers and School Board Member Gilbert. Also in attendance were Principle Planner Eddy Galindo, Assistant City Attorney Chelsea Farrell and Recording Secretary Laurie Dargie.

Vice Chairman Aton made a motion to approve the minutes from the April 5, 2023 meeting. Member Perez seconded. There was a unanimous voice vote.

Secretary Grant made a motion recommending approval of the transmittal of the Comprehensive Plan Amendment CPA#1-2023 Water Supply Facilities Work Plan for 2023 to the state. Member Garrod seconded.

Small Scale Amendment SSA#11-2023 – Dairy Road Luxury Apartments

Mr. Galindo gave an overview of this item. Mr. Galindo provided a revised staff report and pointed out the correction to the Planning and Zoning Commission members.

 

John Marling of 6354 Masters Blvd Orlando, Florida came to speak in favor of this item. Mr. Marling provided a PowerPoint presentation. 

 

Jim McKnight of 1675 S. Fiske Blvd Rockledge, Florida came to speak in favor of this item.

 

James Taylor of 189 S. Orange Avenue Orlando, Florida came to speak in favor of this item.

The Planning and Zoning Commission had discussion with staff and the public speakers.

 

Vice Chairman Aton stated that he was invited by the applicant to attend a meeting regarding this project and he attended only to gather information. Vice Chairman Aton said the meeting he attended does not influence his ability to make a decision regarding this item tonight.

Secretary Grant made a motion to recommend approval of the Small Scale Amendment SSA#11-2023 relating to the annexation of 3.54 acres. Member Fayson seconded.

Member Garrod made a motion to recommend approval of the Small Scale Amendment SSA#11-2023 to amend the comprehensive plan land use amendment from Commercial Low Intensity in the City and Agricultural in the County to the City’s Medium Density Residential. Secretary Grant seconded.

Member Garrod made a motion to recommend approval of the Small Scale Amendment SSA#11-2023 to amend the zoning map by changing the Community Commercial (CC) zoning district to the Planned Development (PD) zoning district on approximately 15.08 acres of property, this motion includes approval of all staff recommended conditions and an additional recommended condition that there be two (2) driveway accesses to this project. Member Perez seconded.

Mr. Galindo gave an overview of this item. Mr. Galindo provided an additional handout for the Planning and Zoning Commission to review.

 

Brian Ashby of 189 S. Orange Avenue Ste 1000 Orlando, Florida came to speak in favor of this item.

Member Garrod made a motion to recommend approval of the Verona Village C – Sketch Plat and to request that the applicant provide traffic calming examples to City Council to illustrate that traffic calming can be done. Vice Chairman Aton seconded.

Petitions & Requests from Public Present

 

Maria Hylton 3100 Demaret Drive Titusville, Florida came to ask Member Fayson what is the Bill number that he referenced from Governor DeSantis regarding Affordable Housing. Member Fayson said it is the Live Local Act Bill 102.

 

Megan Moscoso of 3031 Demaret Drive Titusville, Florida came to speak. Ms. Moscoso said she was attending the meeting in efforts to become more educated in the city’s processes.   Ms. Moscoso said she has tried to contact the City of Titusville staff members via phone messages and emails and has not received responses other than from Mr. Galindo.  Ms. Moscoso said she would like information regarding the Apollo Garden Apartments project just so that the neighbors understand exactly what is coming near to their neighborhood. Ms. Moscoso provided a handout regarding information that has been gathered from different sources for the project. Ms. Moscoso said she is just asking for transparency from the City of Titusville with regards to any additional information they may have regarding this project.

 

Christopher Hylton of 3100 Damaret Drive Titusville, Florida came to speak.  Mr. Hylton had questions regarding the Apollo Gardens project at it relates to zoning.

 

Maria Hylton of 3100 Demaret Drive Titusville, Florida came to answer questions of the Commission.

 

 Patricia German of 392 Waterside Circle Titusville, Florida came to speak. Ms. German spoke about living on a 50 foot wide lot.

Reports

 

Accessory Dwelling Units Discussion

Member Fayson gave a brief over of this item to educate the public present and viewing audience. 

 

Chairman Richardson requested that the Accessory Dwelling Units discussion be placed on the next meeting agenda for the Planning and Zoning Commission and if time allows the Commission will continue the discussion as time permits.

 

Assistant City Attorney Farrell announced the Affordable Housing Summit at the Cocoa Civic Center on May 18, 2023 which will be an education opportunity for the Planning and Zoning Commission to attend on their own as separate individuals. This is a county wide summit open to all the public.  Assistant City Attorney Farrell cautioned the Planning and Zoning Commission members who attend to be aware of the Sunshine Law and to not speak with one another regarding anything relating to items that come before the Commission for discussion. Assistant City Attorney Farrell said she will be giving a Sunshine Law refresher at the June 7, 2023 meeting.

 

Michael Myjak of 4420 Alpine Lane Titusville, Florida came to speak. Mr. Myjak asked Assistant City Attorney Farrell if there could be an ordinance created that would stipulate that a percentage of all new development must have a portion designated to be affordable housing in effort to help with the affordable housing issues within Titusville.  Mr. Myjak also informed the Planning and Zoning Commission that the Titusville Environmental Commission is strongly encouraging the procurement of the forested wetlands throughout the city and for the city to take an aggressive path to redirect stormwater into these forested wetlands.

Community Development Department Spotlight Video

The Community Development Department spotlight video was played for the Planning and Zoning Commission.

Chairman Richardson encouraged the Planning and Zoning Commission members to drive around the city and look at the development taking place because the development that is approved is not always what the developer does.

 

Member Garrod suggested that the city look at potential future issues with higher density residential developments and to consider visiting other cities to see how these higher density residential areas are developed to help with avoiding issues that arise from these developments.  

 

Member Rogers asked what happens to developers who do not comply with the plans that were approved. Mr. Galindo said that there would be code enforcement action taken against them.

 

Member Fayson said that Titusville deserves to be a premier town and we have to start saying no. 

 

Vice Chairman Aton referred to the chart on page 44 of the agenda packet and said the population numbers between 2022 and 2035 is 13,000 people and based on just Verona, he does not see how these numbers are even close and doesn’t feel that it adds up correctly.
