  1. Minutes

The Titusville Environmental Commission (TEC) of the City of Titusville, Florida met in regular session at City Hall in the Council Chamber located at 555 South Washington Avenue on Wednesday, May 11, 2022 at 5:30pm.

Chairwoman Thompson called the meeting to order at 5:30pm. Present were Vice Chairman Rice, Member Perez, Member Tucker, Member Yount, Member Myjak, and Alternate Member Young were present. Alternate Member Flis was absent. Staff present was Senior Planner Eddy Galindo, Sustainability Planner Rachel Muller, Assistant City Attorney Chelsea Farrell and Recording Secretary Laurie Dargie.

Vice Chairman Rice made a motion to approve the minutes from the April 13, 2022 meeting. Member Perez seconded. There was a unanimous voice vote in favor.

Chairwoman Thompson asked the Titusville Environmental Commission members to consider making a motion to watch a six minute video at tonight’s meeting before the Commission gets into the agenda items.

Chairwoman Thompson requested that the Titusville Environmental Commission move agenda item 8A to be heard after petitions and requests. Chairwoman Thompson said that the Commission can consider hearing or tabling items 7A, 7B and 7C depending on meeting time. The Commission members agreed to hear item 8A after petitions and requests.

Petitions & Requests from Public Present

 

Stan Johnston of 860 Poinsettia Avenue Titusville, Florida came to speak. Mr. Johnston spoke about concerns regarding a state survey on the SNJ Oaks project.

 

Toni Shifalo of 715 Tropic Street Titusville, Florida came to speak. Ms. Shifalo spoke about the importance of the Titusville Environmental Commission and the need for members to attend City Council meetings when environmental issues are brought up that come before the Titusville Environmental Commission.

 

Member Myjak and Member Young arrived to the meeting.

 

Vice Chairman Rice said he would yield to the State Boards Surveyors regarding Mr. Johnston’s concerns.

 

Nayra Atiya of 2285 Beechwood Court Titusville, Florida came to speak. Ms. Atiya passed out a handout regarding right to clean water.

 

Member Myjak asked that the Titusville Environmental Commission take action on making a recommendation to City Council to support the right to clean water.  Chairwoman Thompson said that this would need to be discussed after the new business item 8A.

Member Perez made a motion to have discussion about the right to clean water on tonight’s agenda after hearing the new business item 8A. Member Myjak seconded. There was a unanimous voice vote.

Chairwoman Thompson disclosed that she received an e-mail from Matt Hayden.

 

Vice Chairman Rice disclosed he reached out to a concrete crushing facility in Texas to ask questions.

 

Member Tucker and Member Perez said that they also received some e-mails. The Commission members believe they all received the same e-mails.

New Business

 

Conditional Use Permit CUP# 2-2022 – Independence Recycling

Mr. Galindo gave an overview of this item.

 

Chairwoman Thompson provided a handout of soil interpretive maps of soil drainage and water table depths. 

 

Tara Tedrow, attorney for the applicant, 215 N. Eola Drive Orlando, Florida came to speak in favor of this item. Ms. Tedrow started a PowerPoint Presentation on the Independence Recycling project.

 

Greg Moro, applicant, 1150 Duncan Road Punta Gorda, Florida came to speak in favor of this item.

 

Member Myjak read an article that he requested be on record. Assistant City Attorney Farrell asked if he had a handout for the applicant and the Titusville Environmental Commission members. Member Myjak said no.

 

Lance Traves of 239 South Court Street Medina, Ohio came to speak in favor of this item. Mr. Traves provided a detailed report analysis to the applicant and a copy of the report was provided to the Recording Secretary as part of the record.  

 

John Zemball of Zahn Engineering 150 S. Palmetto Ave Suite 201 Daytona Beach, Florida came to speak in favor of this item.

 

Discussion took place amongst the Titusville Environmental Commission, Ms. Tedrow, Mr. Moro, Mr. Traves, Mr. Zemball and city staff.

 

Member Myjak made a motion to extend the meeting for one hour. Member Perez seconded. There was a unanimous voice vote in favor.

 

The Titusville Environmental Commission took about a ten minute recess.

 

Patricia McKenna of 5873 Chicory Drive Titusville, Florida came to speak against this item.

 

Toni Shifalo of 715 Tropic Street Titusville, Florida came to speak against this item.

 

John Stanton of 6935 Riveredge Drive Titusville, Florida came to speak against this item.

 

 

Discussion continued.

 

Member Myjak made a motion to extend the meeting for one hour. Member Perez seconded. There was a unanimous voice vote.

 

Stan Johnston of 860 Poinsettia Avenue Titusville, Florida came to speak neither for nor against this item.

 

Susan Schricker of 6975 Riveredge Drive Titusville, Florida came to speak against this item.

 

Ms. Tedrow, Mr. Traves, Mr. Moro and Mr. Zemball answered questions and concerns that were brought up by the public and Commission members.

 

Member Myjak made a motion to extend the meeting for one hour. Member Perez seconded. There was a unanimous voice vote.

Vice Chairman Rice made a motion to approve Conditional Use Permit CUP#2-2022 – Independence Recycling with the following conditions:

 

  1. Enhanced buffers (25ft North and West, 30ft East, and 50ft South) 
  2. A 6ft tall opaque fence to the south (Golden Knights Blvd), to be located behind the required natural landscape 50ft buffer.
  3. A sound continuation barrier interior of the buffers to limit the sound to 65db at property line is required  
  4. A water-based dust suppression system required on site
  5. A sound study is required to be submitted to the City for their review and approval
  6. All State required reports on testing of air, water, soils etc. must be provided to the City of Titusville
  7. All emergency response procedures be provided to the City to be reviewed and accepted by the City during site review process   
  8. All stockpile areas shall be treated as impervious surface for the stormwater calculations during site development permitting
  9. Operations to be from 7am-4pm Monday-Friday
  10. All on site equipment must use the white noise backup sound

 

Member Perez seconded.

Member Myjak voted no because he felt the hydrology of the property and surrounding area needed to be studied.

Discussion took place on the right to clean water item that was added to the agenda by vote.

Member Myjak made a motion to recommend to City Council that they support the Right to Clean Water Charter Amendment and vote to have it on the ballot.  Member Perez seconded.

Petition & Requests

 

Toni Shifalo of 715 Tropic Street Titusville, Florida came to speak. Ms. Shifalo asked which TEC member will present the Semi-Annual report to City Council. Vice Chairman Rice said he would present the report.

Member Yount made a motion to table agenda items 7A, 7B, and 7C until the June 15, 2022 Titusville Environmental Commission meeting. Member Perez seconded. There was a unanimous voice vote in favor.

Reports

 

Member Myjak said he will be going out of state from June to October and would like to step down as an alternate. Member Myjak said he will make the request to City Council for a leave of absence.
